Divorce isn’t a word that one associates very heavily with Indian society. In fact, there are no statistics available on the number of marriages that end in divorce, only estimates.

Traditionally, marital dissolution in Indian society was not a choice a woman could make, if only owing to her slightly lower status in society.

However, with the transitioning of India as we step into the 21st century, more and more women are finding equal status with men. Especially in urban areas, homes with two incomes are quickly becoming the norm.

When it comes to entrepreneurship however, this financial equality is often an extra strand in the thread joining man and woman.

It is estimated that in Mumbai, about 35% women who run small to mid-size businesses have family members (especially spouses) with some interest in the business. Often, when a marriage breaks, this business partnership also dissolves.

The issues that arise from equal-share jointly owned businesses are numerous, the most significant of them being legal. Since family law and civil law are still backdated in this country, there aren’t explicit guidelines for mutually agreeable steps that can be taken in such a scenario.

Speedy divorce cases do allow for court-approved mediators to help reach a settlement, since there exist several ambiguities in what is an acceptable settlement. The legal conundrum that exists arises because there isn’t a definite overlap between partnership law and marriage law.

Often, especially in the services industry, one or both spouses are the face of the company. A client roster, in these cases, gets used to having a familiar face in their business dealings. Divorces can often, directly or indirectly affect the business in this way. To be able to introduce a new face to a client and gain the same trust, or worse, tussle in competing firms for a client, can more often than not prove detrimental to the cause of both the warring parties.

Nikita Kadam, who ran a successful event management company had finally graduated to doing corporate big-ticket events, says, “The client point-blank refused to work with me after my husband left me. I definitely got the company, but in our business, a company is only as big as the client list we have.”

Often, with such stories, one finds that you have to build back as much of your business as you have to your personal life. Kadam’s husband, Karthik, who settled the marriage amicably and was moving out of the country, even tried to assist Nikita with said clients, but they insisted that their faith lay in him being at the helm of their account.

In some cases, women choose to have the men overseeing the financial aspects of their company’s interests, and aren’t entirely aware of asset valuations, and work value. Especially in some small companies, where the male spouse has a part time interest whilst enjoying full-time employment elsewhere, the main business owner, the woman, may get a raw deal during the dissolution of the partnership, with an undervaluation of her contribution to the company.

Logistically, it is often best to divide the company equally and share clients and accounts. Divorcing the residual emotions from the failure of your marriage can be significantly helpful in reaching a mutually beneficial state of affairs.

A prominent health club franchise owner, who wishes to not be named, was heard saying that she was glad that the anger she felt for her husband, upon discovering his infidelities, did not extend to the settlement table.

They split their franchise into two, and she is now earning a significantly higher amount by being more aggressive in her operations of a smaller number of gyms. It goes without saying, of course, that she’s glad she doesn’t have the emotional stress of a marriage on the rocks pulling her productivity down.

These are just a few of the issues that female entrepreneurs who have spousal interests in their enterprises face. The solution to these issues is essentially the same, but not a very popular route, especially in India.

In cases where a woman owns a business prior to her betrothal, it is advisable to have a pre-nuptial agreement stating the extent of his involvement in the business and agreeable terms of settlement in case of a separation. This agreement can be revisited upon changes in the business or of each party’s involvement, but since the social implications of it are not entirely kosher, women generally choose to not adopt such safeguards.

Again, for couples who start businesses together, it is advisable to create firm partnership agreements or post-nuptial agreements, and revisit them from time to time. Post-nups of course aren’t as legally sound as pre-nuptial agreements, but they still provide for some legal safeguards.

A fair conclusion that can be drawn from these investigations is that whilst one would hope for a marriage to last forever, in the current environment, a guarantee of any sort cannot be made. Working with your significant other can be very rewarding, and at the same time it can be very risky in case of future discord.

Returning To Work: Back-To-Work Programmes For Indian Women

Whether by personal choice, or as a result of unalterable circumstances, many working women in India today take sabbaticals and other extended periods of leave.

By the time circumstances change for the better, re-entering the workforce can often be difficult and frustrating. However, there are avenues out there that you can access to make the transition back to work in a smooth, hassle-free manner.

Legal Provisions For Working Women In India:

It’s important to know your legal rights as a woman and an employee. The Maternity Benefits Act, 1961, applies to all women across India employed with their organisation for at least 80 days in the past 12 calendar months.

It specifies that a woman has right to paid leave for at least six weeks after the date of delivery (or miscarriage) of her child, and to be fully reinstated to her previous position after that minimum period of time. In the event of illness caused by said delivery or miscarriage, additional leave with full pay must be granted for the maximum of one month.

However, many companies have their own HR policies about maternity leave, benefits, and return-to-work that go beyond the Government’s minimum guidelines: they can offer anywhere between 3-6 months of leave apart from guaranteed reinstatement upon return.

Check with your own company’s policies and your employment contract to be sure of your individual benefits and assurance of reinstatement. While these provisions specifically apply to women taking time off for pregnancies and childbirth, some companies have similar provisions for personal sabbaticals.

Larger corporations tend to have better policies – for women who work in smaller set-ups, insisting on your legal rights and a written agreement (ideally before the start of your leave) is an advisable course of action.

Corporate Programmes For Working Women:

The Tata Second Career Internship Programme for Women (SCIP) is a “career transition management programme for professionals.” It is geared towards women professionals who have worked for four continuous years in the fields of HR, Marketing, Finance, Legal, Manufacturing, and related areas, and have taken sabbaticals for anywhere between 1-8 years.

The internship is a paid one. It does not guarantee placement at the end of the programme, but interns “have the option of exploring full-time employment on mutually acceptable terms with the respective Group Company.” For more details, application forms, and deadlines, visit:

Back-To-Work Workshops & Courses for Working Women:

Fleximoms runs a series of workshops called 2nd Chance, which pegs itself as India’s first back-to-work programme for women. These 2-day workshops are held in Delhi, Noida, and Gurgaon, and enquiries about their fees can be directed to the email address/telephone numbers available on their contact page. Fleximoms additionally runs a “preparedness” module that helps women going back to work be up-to-date with jobseeking trends and skills.

The School of Inspired Leadership (SOIL) offers a one-year programme called Career Reconnect for Women, also aimed specifically at women getting back to work after a sabbatical. The programme aims to “help women gain insight into relevant and contemporary areas of business that will help them rejoin corporate life or start their own entrepreneurial venture.” The programme, which begins in August, is a bit pricey at Rs.7,46,950, but includes accommodation and meals at the SOIL campus in Gurgaon, NCR.

Tips for Women Going Back to Work

• In interviews with employers, be frank and unapologetic about the time you took off from work. Be direct about what your priorities were at the time, and what they are now.

• If you’re currently on a sabbatical and will be for a while longer, consider getting back into your field on a part-time or consultant basis. This way, when you return to work full-time, employers will have less reservations about hiring someone who’s been “out of the game” over somebody who has recently graduated.

• When returning back to work, let employers know how you’ve been keeping up-to-date on your skills all the while. As a returning legal adviser or attorney, for example, you should demonstrate how aware you are of legal precedents since the start of your sabbatical; if you’re a certified professional in your field, show them how your accreditations are current.

Single Career Women: Challenges Of Working Women In India

Changing social trends indicate a significant rise in the number of single career women all over the world. Earlier, as we all know, women were expected to remain, and manage things, within the confines of their homes.

But nowadays, people are opening up to the fact that women are also capable of working in commercial fields and earn a living for themselves.

After much clamor about treating women as equals and abolishing gender discrimination, we now see a significant rise in the number of women, especially in high managerial positions and large companies.

However, there are still some key problems that single career women in India have to face in their day-to-day lives.

  • Domestic Issues:

The families of many single career women are still to accept them as bread earners. This is true, especially for developing like India, where the society is strictly patriarchal. Even if some of them do accept their daughters as working individuals, they still do not like to see them outshine their male siblings.

Says Niti, a 28-year old bank manager, “Even though I earn much more than my brother, my parents tend to take his job and professional demands more seriously. If there is a family wedding coming up, I am the one expected to take leave from work to attend it.”

While some single career women do not have the issue to deal with the issues above, their families do restrict their time out of the house due to safety concerns. Paranoid parents may unknowingly hamper their daughters’ professional growth by allowing them work only during specific day hours or in pre-defined professional settings.

Ruchi, 23, says, “My dad was against the very idea of me working in a call center as it involved night-shifts. Even the former was more lucrative, I had to take up a job at a day-care center as a receptionist.”

In nations like India, people are still concerned about what their neighbors or relatives might think about a certain issue. Even if the parents of single working women do not have problems with their daughters going out for work, people around will offer unsolicited advice.

This sometimes influences the parents’ mindset and they may begin pestering their daughters into sidelining their professional aspirations to get married and start a family. Given the tedious, and often futile, task of convincing their parents, the woman finds little support from her loved ones.

Swastika (name changed), a 25 year old IBM consultant, says, “I almost convinced my parents about taking up a job with the local newspaper at the start of my career when, my aunt gave her ‘valuable’ opinion about working females to my dad. I won the ‘battle’ single-handedly, with only my convincing power as my weapon.”

Some Indian men are yet to come to terms with the fact that women are also capable of being competent and professional workers. Single career women thus face the challenge of fighting their way through a chauvinist society.

  • Work Issues:

Single career women, are often discriminated at the workplace. They are always compared to their male counterparts, and even pitched against them in unfair situations.

Even though most large organizations have now come up with equality laws and regulations, there is always an underlying current of criticism that working women have to face from their peers, as well as, seniors.

Often career women may have to take a break from their work as they’re expected to take care of family issues. But more often than not, these sabbaticals result in women missing out on significant career opportunities and receive little support when they plan to rejoin the work place.

Jeannette Cleveland, in her book titled, Women and Men in Organizations: Sex and Gender Issues at Work, says, “… these (career) women succeeded by taking risks, pursuing line responsibility, managing people effectively, and having mentors- much like male executives …”

Despite these odds, single career women nowadays seem to sail through all these issues with much ease. The most important advantage they have over their married colleagues is that they can focus on their careers without the distraction of having to run back home to their husband and children. This allows them to grow and to be promoted faster, resulting in greater career satisfaction.
